Prenuptial / Postnuptial Agreements


Prenuptial, Antenuptial, and premarital agreements

Antenuptial, prenuptial, or premarital agreements (all mean the same thing) are contracts. They are treated by courts in the same manner as ordinary contracts, governed by contract law, and subject to the principles of contract law. Further, duly executed prenuptial agreements are accorded the same presumption of legality as any other contract. An antenuptial agreement must comport with the rules governing the formation of all contracts, including the necessity of consideration, except where specified by statute, the signature of the parties, identification of the parties, terms (full and fair disclosure is essential), and the absence of fraud, duress, or incompetency. The mere fact that one has failed to read the agreement or have counsel approve the agreement is not grounds for voiding the agreement. Further, the claim of duress because of an impending marriage, without more, is insufficient to void a premarital agreement.
