Windshield Obstructions take a Hit as Police Reason to Pull Over Motorists

Perhaps you've heard tale that cops cannot pull you over for the traffic violation of having windshield obstructions, such as "fuzzy dice."  That's not completely accurate.  Under the motor vehicle code, the police may pull you over for windshield obstructions.  The Code provides that "[n]o person shall drive any motor vehicle with any object or material hung from the inside rearview mirror or otherwise hung, placed or attached in such a position as to materially obstruct, obscure or impair a the driver's vision."  This would include those "fuzzy dice", but also a GPS gadget that's attached in such a manner to the inside winshield to obstruct vision.  We all have those on our windshields nowadays.  Now, this offense doesn't carry a big fine or penalty, but it's the offenses that do once you are lawfully pulled over for the "fuzzy dice," such as DUI that do.

In a recent PA Supreme Court case, the officer had the evidence from his stop suppressed by the court because he failed to testify to the size and general description of the objects hanging from the rearview mirror or how they impaired the view of the driver.  Rather, the officer only testified that he believed the object obstructed the vision of the driver.
